These Terms and Conditions ("Terms") govern your use of the website www.makyee.com (the "Site") and the services provided by Makyee Real Estate Brokerage LLC ("Makyee", "we", "us", or "our"). By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

1. Use of the Site

1.1. You must be at least 18 years old and have the legal capacity to enter into contracts to use the Site and our services. By using the Site or our services, you represent and warrant that you meet these requirements.

1.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

1.3. You agree to use the Site and our services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.

1. Services

2.1. Makyee provides an online platform that facilitates the buying and selling of properties for investors, buyers, and sellers worldwide. We may offer various services, including property listings, transaction facilitation, and related services.

2.2. We do not own, inspect, or control the properties listed on our Site, and we do not guarantee the accuracy, completeness, or quality of any listings or property information. We are not a party to any transactions between users, and we do not provide any real estate brokerage services.

1. User Content

3.1. You may have the opportunity to submit or upload content, such as property listings, reviews, comments, or other materials (collectively, "User Content"), to the Site. By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

3.2. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to submit the User Content and to grant the rights granted herein.

1. Intellectual Property

4.1. The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Makyee or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except as necessary for your own personal, non-commercial use or as permitted by applicable law.

1. Limitation of Liability

5.1. To the fullest extent permitted by law, Makyee and its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Site or our services.

1. Indemnification

6.1. You agree to indemnify, defend, and hold harmless Makyee and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or our services.

1. Governing Law and Jurisdiction

7.1. These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site or our services shall be exclusively resolved by the courts located in Dubai, UAE.

8.1. We may update or modify these Terms from time to time in our sole discretion. We will notify you of any material changes by posting the updated Terms on the Site. Your continued use of the Site or our services after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
